COMPANIES – JURISDICTION – ANTI-SUIT INJUNCTION OVER FOREIGN LITIGATION
Anti-suit injunctions traditionally fall into two categories. The first, and more common, category involves a litigant ignoring a contractual obligation to litigate disputes in a particular forum or jurisdiction. The second, less common category involves the Court injuncting a litigant whose commencement of foreign litigation is considered unconscionable for different reasons.
